集体土地征收补偿中公众参与问题的探究——基于山东省S村的调研

On the Public Participation in the Collective Land Expropriation Compensation——An Investigation Based on S Village in Shandong Province

我国土地征收补偿中政府拥有单方决定权,被征地农民总是处于弱势。忽视土地征收程序中的公众参与,农民的权益得不到保障,当积怨加深,极易爆发群体性事件。为避免群体性事件的发生,需要构建公众参与的土地征收补偿程序。完善信息公开、征地听证、协商以及救济制度,特别是要正确发挥村委会的作用,从而可以更好地保护被征地农民的利益。

The government has unilateral power to make decisions in the land expropriation compensation in China,and the farmers whose land is expropriated is always in a weak position.The ignorance of the public participation in the process of land expropriation and the protection of farmers’ rights and interests are more likely to lead to mass incidents.In order to avoid the occurrence of mass incidents,it is essential to construct the procedure of the land expropriation compensation with public participation.The measures to improve the information publicity,the system of hearing,consultation and relief,in particular to play the role of the village committee correctly,would protect the interests of land-expropriated farmers in a better way.
