论网络食品交易第三方平台的惩罚性赔偿责任——兼评新《食品安全法》第131条第1款

Punitive Liability for Internet Platform Providers in Food Trade——Comment for Article 131 Section 1 in Food Safety Act

新《食品安全法》针对网络食品交易第三方平台做出了法定的义务性规定。第三方平台成为了与经营者承担连带责任的主体。通过对惩罚性赔偿制度的理论性剖析及本法第131条第1款的适用性分析,第三方平台具有连带的承担惩罚性赔偿责任的可行性。从第三方平台法定义务的违反、消费者损害及经营者明知来做出条件的限定,将更好地解决惩罚性赔偿制度在第三方平台适用中出现的问题。

Internet Platform Providers for Food Trade as a third Party are required to accept the obligations according to the new＂Food Safety Act＂. Operators and Internet platform providers are undertaking the joint liability. By the analysis about the Article131 Section 1,the third party has the feasibility to apply to punitive damages rules. For pursuing a better way to solve the problems at the applicative process,we can make limitations for three aspects,breach of duty about Internet platform providers,consumers＇ damages and operators＇ knowing.
