System Improvement and Mechanism Construction of Criminal Protection for Chinese Network Safety

网络安全及其刑事保障是全球课题,《网络犯罪公约》和"信息社会与刑法"决议等先后供给了有益的刑事治理经验,中国也积极迎头赶上。应加快整合实体法与程序法资源,聚焦刑法立法升级换代与刑事诉讼模式重塑,着力推动刑法与刑事诉讼的网络知识转型,协同落实具体任务清单。应以"同呼吸、共命运"与联合国的主导地位为基本法治思维,以国际公约制定工作为当前要务,积极推动司法合作、锁定国际公约模板、创新联合国工作机制等一揽子议程的整体实现。

The criminal protection of network safety is an international issue,which has obtained useful international experience of criminal governance from'Convention on Cybercrime'and the resolution of'Network Society and Criminal Law',so China should also positively keep up. The substantive criminal law and the criminal procedural law should be combined and integrated according to the circumstances of network,while massive countermeasures in criminal legislative revolution and procedural transformation should be promoted. 'Share a common destiny'and closely connecting to the dominance of the UN should be the basic philosophy concept for international cooperation,the formulation for International Network Convention should be the primary task,and judicial cooperation,the mode of International Network Convention and uniform mechanisms for UN actions should be initiated.
