荀子重法思想刍议

On Xunzi's thought of emphasis on the role of law

荀子重法既是礼之规范性的逻辑进展,又是荀子为了适应变化了的现实进行的调整,也是为了弥补教化的不足。荀子通过礼法并举、释礼为法以及直接强调法的作用等途径提升法的地位。荀子之法具有过分重刑、人治主义等色彩,并且只是礼的辅助手段,与近代的法治精神相去甚远。

Xunzi's emphasis on the role of law was not only the logical progress of the normalization of propriety( Li),but also the adaptation to the changing reality. It also made up for the lack of enlightenment. Xunzi enhanced the status of law by using Li and law,interpreting Li as law,and directly emphasizing on the role of law.Therefore,Xunzi's law put too much emphasis on penalty instead of law,and inevitably had the color of the rule of man and was only supplementary means of Li. Xunzi's view of law differed far from the view of modern law.
