司法公正视野下司法鉴定过程中的质量监控探析

Quality control in the process of forensic identification in judicial justice

党的十八届四中全会《决定》提出:"推进以审判为中心的诉讼制度改革,确保侦查、审查起诉的案件事实证据经得起法律的检验"。审判是诉讼最重要的环节,也是维护社会公平正义的最后一道防线。司法鉴定的质量直接关系到审判工作的公正、公平,以及是否能够有效保护人民获得公平正义的基本权利。因此,有必要从司法鉴定过程中质量监控所存在的问题出发,探析质量监控过程中的程序及规范,以弥补当前司法鉴定工作的不足,使其更好地适应以审判为中心的诉讼制度改革。

The Decision of the Fourth Plenary Session of the Eighteenth Central Committee of the Communist Party of China put forward： ＂Promote the trial-centered reform of the litigation system and ensure that the investigation and examination of the facts of the prosecution can stand the test of the law＂.Trial is the most important part of litigation,and also the last line of defense to maintain fair and just.The quality of forensic identification is related to the justice and fairness of the trial,and whether it can effectively protect the people to get the fundamental rights of fairness and justice.Therefore,it is necessary to proceed from the problems of quality control in the process of forensic identification and to analyze the procedures and norms in the process of quality control so as to make up the deficiency of forensic identification and to make it better adapt to the trial-centered reform of the litigation system.
