专卖执法权在执法实践中存在被滥用的可能,执法监督是有效规范执法活动,防止权力滥用的必要手段。然而,伴随依法行政的深入推进和公民权利意识的日渐觉醒,烟草专卖执法面临的法律风险不断增加,现行的执法监督模式不够系统和深入,对专卖执法权力的滥用难以形成有效制约,更不足以应对日趋复杂的执法风险。有鉴于此,构建全新的专卖执法监督体系势在必行。执法监督体系的构建应当将重心放在内部监督,着力围绕完善同级审计部门和纪检监察部门监督、优化上级主管部门对下级业务部门监督以及强化对专卖执法全过程监督等层面展开。

The existence of monopoly law enforcement powers could be abused in the practice of law enforcement. Law enforcement and supervision is effectively regulating law enforcement activities, which is the necessary means to prevent the abuse of power. However, with further promotion of the administration and according to law and the rights of citizenship increasingly awakening, legal risks faced by the tobacco monopoly law enforcement continues to increase, the current mode is not enough for law enforcement and supervision system and the depth of the monopoly law enforcement abuse of power is difficult to form an effective constraint, and there is not enough law enforcement to deal with increasingly complex risks. In view of this, building a new monopoly law enforcement supervision system is imperative. Construction law enforcement supervision system should be focused on internal over- sight, efforts to improve around the same level discipline inspection and supervision departments and audit supervision departments to optimize the higher authorities to subordinate business units and strengthen monopoly oversight of law enforcement and other aspects of the whole process of supervision is expanded.
