摘要
加拿大银行服务和投资申诉专员(OBSI)是金融申诉专员机构的典型代表,其总章程在会员、会员费与会员大会等三个方面的规定内容详实,设计精妙,在维护会员权益与机构公平之间保持平衡,对我国的金融申诉专员机构具有极为重要的启示。应针对我国金融申诉专员机构的两种具体形态(社会团体与民办非企业单位)的现实问题,借鉴OBSI的有关规定,推动我国金融申诉专员机构的持续发展。
The Ombudsman for Banking Services and Investments, Canadian (OBSI) is a typical representative of the financial ombudsman schemes. Its general constitution prescribes its members, membership' fees and members' meeting in detail and is well designed to maintain the balance between the fights and interests of members and the equity of OBSI, which has a very important reve- lation to China' s Financial Ombudsman Schemes. Measures should be taken to promote the sustainable development of the Financial Ombudsman Schemes in China in view of the practical problems of the two specific forms (such as social groups and private non - en- terprise units) of China' s Financial Ombudsman Schemes and learning from the relevant provisions of OBSI.
