我国无人机海洋维权执法的国际法问题初探

A Preliminary Study on the International Law Concerning Maritime Law Enforcement of China's Unmanned Aerial Vehicles

将无人机技术应用于海洋,已经成为沿海国海洋维权执法活动的重要趋势。然而,对于无人机的法律属性,以及将无人机用于实施海上紧追、武装无人机用于海上执法等现实或潜在的法律问题,都急需探讨。本文从国际航空法、海洋法,以及武装冲突规则和国际人权法多个视角,对无人机应用在海洋维权执法中的国际法予以探讨,为今后我国的海洋维权执法实践提供依据。

The Unmanned Aerial Vehicle（ UAV） has been widely used in the ocean areas,and such usage has been an important trend for maritime law enforcement of the coastal states. However,UAV＇s legal attributes,as well as the use of unmanned aerial vehicles for the implementation of maritime hot pursuit,armed unmanned aerial vehicles for maritime law enforcement,and other real or potential legal issues are urgently needed to explore.This paper aims at analyzing problems of international law evoked by the use of the UAV in maritime law enforcement,taking into account of various angles of aviation law,the law of the sea,international human right law,and the law of armed conflict,so as to provide theoretical basis for the practical needs of China＇s maritime law enforcement.
