Prevention of Unjust,False and Wrong Cases——In view of socialism ruling by law

防范"冤、假、错"案的发生,需要在社会主义法治理念指引下,从我国现阶段的实际出发,针对"冤、假、错"案发生的主要原因,在法律制度上进一步完善法律法规,强化司法人权保障;侦查环节上强化内部监督,注重科技应用;审查起诉和审判环节上排除证据收集和认定事实的"合理怀疑";社会层面上增强法治意识,提高诚信程度等,努力实现既不"冤枉一个好人",也不"放纵一个坏人"的良好社会效果与法律效果。

The prevention of unjust,false and wrong cases could be achieved through improving laws and regulations,strengthening assurance of judicial human rights in legal system according to the main reasons of wrong cases and present reality in China led by socialism ruling by law; strengthening inner supervision and emphasizing technology application in investigation section; excluding the reasonable suspicion on evidence collection and facts recognition in prosecution and trial; increasing consciousness of ruling by law and integrity in social level so as to achieve good social and legal effect of neither wronging nor indulging anyone.
