预防刑事错案的发生——从改进侦查内部机制的角度

Precaution of Criminal Wrong Cases——In view of improving inner mechanism of investigation

近年来,刑事错案被屡次披露,这一方面体现了我国司法的民主、进步,另一方面民众对司法的公正产生质疑。这不禁带给我们深思,错案是如何发生的,怎样才能避免错案的发生?文章从改进侦查机关内部机制的角度来探讨预防错案的发生,以期能够警示侦查机关加快队伍建设,顺应以"审判为中心"的诉讼制度,转变执法理念,规范执法行为,加强内部侦查监督,从源头上预防错案的发生。

Recently,criminal wrong cases were disclosed several times,which reflected not only the democracy and progress of Chinese judicature but also the doubts of the civil to justice.The paper discussed the precaution of wrong cases from the improvement of inner mechanism in investigation organ so as to warn public security organs of quickening team construction,complying with the lawsuit system with trial as center,changing law enforcement ideas,regulating law enforcement behavior,stressing supervision in inner investigation and preventing the happening of wrong cases from the origin.
