摘要 由于特殊的历史背景,以色列是发达国家中少数采用土地公有制的国家。以色列实行公有土地租赁制度,租期一般为49年,近年来不断延期为98年甚至196年,土地到期后实行自动有偿续约的制度。本文通过研究以色列公有土地租赁制度,旨在为我国完善土地使用权制度提供借鉴和参考。完善土地使用权制度一方面要保持政策的连贯性和稳定性,另一方面也要注重维护民众权益。 Israel executes the public ownership of land which is rare in developed countries because of its special historical background. Israel's public land can only be leased for 49 years, which has been postponed for 98 or even 196 years recently. An automatic paid extension system is implemented after the expiration of the lease contracts. This paper provides some proposals and references for improving the land use rihgts in China by studying the lease system of public land of Israel. We need to safeguard the fights and interests of our citizens, as well as maintain the continuity and stability of the policy in the process of improving the land use rihgts
