摘要
近些年,国内侵犯知名商品特有包装装潢的案件屡有发生,与之相关的个案裁判结果往往出现较大分歧,甚至发生"相同或者类似案件不同处理"的情况,其在很大程度上与侵犯知名商品特有包装装潢行为构成制度存在的问题有关。就学理层面而言,学界对于有关侵犯知名商品特有包装装潢行为构成理论仍存争议;而就实践层面来看,相关问题更是日趋凸显,包括知名商品认定存在欠缺、特有包装装潢认定存有误区、擅自使用认定存在不足,以及混淆或者误认认定存有漏洞。基于问题导向主义之思维,提出删去"知名商品"限定、完善包装装潢特有性之认定、拓宽擅自使用的认定范围以及纠正混淆或者误认中存在的问题等改进建议。
Recently, cases of infringement of the special packaging and decoration of renowned goods occurred frequently in China, and there have been divergences in results of judgments of related cases. Sometimes even similar cases might be dealt with differently, which have a lot to do with problems in the act constitution systems for infringement of the special packaging and decoration of renowned goods. Theoretically, there are still controversies on constitution of behaviors of infringement of the special packaging and decoration of renowned goods in academia, and for practitioners, related problems have also become prominent, including incompleteness and deficiency of definitions of a serious of terms, such as renowned goods, special packing and decoration, use without authorization, and confusion or mistakes. Based on problem-oriented thinking, this article puts forward some strategies, including deleting limits of renowned goods, improving definition of specificity of packing and decoration, broadening range of use without authorization, and correct problems in confusion or mistake.
