涉外贴牌加工中商标侵权问题刍议

DISCUSSION ON TRADEMARK INFRINGEMENT ISSUES OF OEM PROCESSING

涉外贴牌加工是经济全球化的产物,在我国经济发展中占据重要地位。同时,与此相关的商标侵权纠纷日益增多。在理论和司法实践中,对于涉外贴牌加工中涉及到的商标侵权问题并无统一认识。目前争论点主要在商标性使用、混淆、商标地域性等问题上。结合商标法的基本理论,从商标法的立法宗旨与商标的功能等角度出发,厘清争议,并从立法、司法、企业防控等方面提出建议。

OEM is the product of economic globalization,occupies an important position in China's economic development. At the same time,the trademark infringement disputes are increasing. In theory and practice,for trademark infringement in OEM processing involves no unified understanding. At present,there are many disputes in the aspects of trademark use,confusion and trademark regionalism. Based on the basic theory of trademark law,this paper clarifies the dispute from the legislative purpose of trademark law and the function of trademark,and puts forward some suggestions from legislation,judicature,enterprise control and so on.
