我国非行政许可审批事项的规制思考

ON THE REGULATION OF NON ADMINISTRATIVE APPROVAL ITEMS IN CHINA

"非行政许可审批"这一概念是随着行政许可法的产生而产生的。尽管行政许可法已经颁布并实施了多年,但伴随着它的实施也存在着许多问题,非行政许可审批事项的规制便是其中最为突出的问题之一。对于出现的非行政许可审批问题,我国并没有设置专门的法律法规进行规制,再加上其范围的模糊,造成了法律适用以及相关管理的混乱。为了使我国非行政许可审批的相关内容更加明确,更好地通过法律对其规制,本文通过"是什么""为什么""怎么办"的传统问题分析方法,分别从非行政许可审批概念的界定、非行政许可审批带来的问题以及非行政许可审批的归宿三个方面对我国非行政许可审批的相关内容进行分析。

The concept of 'non administrative licensing examination and approval' is caused by the administrative licensing law. Although the administrative licensing law has been promulgated and implemented for many years,but there are many problems with its implementation. The regulation of non administrative approval is one of the most prominent problems. For the non administrative licensing examination and approval,China has not set up special laws and regulations to regulate,coupled with its scope of ambiguity,resulting in the application of law and related management confusion. In order to make the relevant contents of the administrative examination and approval in China more clearly,better through the law of its regulation,through the ' what' and ' why' and ' how to do' the traditional analysis method,respectively,from the examination and approval of non administrative license,the definition of the concept of non administrative license examination contents related to three aspects of number of problems and the non administrative approval destination of China's non administrative approval analysis.
