录囚制度对我国审判监督程序的借鉴

随着我国法治现代化不断深入,立法工作呈现一片欣欣向荣的景象,但司法层面却多有不足。如我国的审判监督程序未能充分发挥其功能,近年来冤假错案时有发生。录囚制度是我国古代封建王朝采用的司法防错纠错机制,本文介绍录囚制度的发展脉络,分析其内在司法理念和制度特征,提出可供审判监督程序借鉴之处:建议增设专门委员会、加强审监主体的能动性、加强侦查、起诉环节的监督、细化申诉条件,完善审判监督程序。

With China's deepening of modernization of the rule of law,the legislative work showing a thriving scene,but the judicial level is more inadequate. As our judicial supervision procedure failed to give full play to its function,in recent years the miscarriages of justice occurred. The prison system recorded in ancient China feudal dynasty by judicial error prevention and error correction mechanism this paper introduces the development of the recorded prison system,analyzes its internal judicial idea and system characteristics,puts forward for the trial supervision procedure reference: proposed the creation of special committees,strengthen the initiative,strengthen investigation and trial supervision subject,supervision and prosecution of the appeal,refinement,perfect the procedure of judicial supervision.
