为规范经营者承诺制度,国家发改委公布了《反垄断案件经营者承诺指南(征求意见稿)》,规定了经营者承诺制度的具体程序,弥补了《反垄断法》第45条之不足,但该征求意见稿在透明度、监督力以及惩罚力方面仍稍显无力,通过公开经营者承诺、采取多样化监督以及提高惩罚力度可以解决该征求意见稿之缺陷。

The national development and Reform Commission（ NDRC） promulgated the guidelines for the commitment of the operators of anti monopoly cases（ Draft for comment） to regulate the operator’s commitment system,Which provides the specific procedures for the operator’ s commitment to the system,and makes up for the ＂ anti-monopoly law,＂ the lack of forty-fifth. But the draft in transparency,supervision and punishment force is still slightly weak. The defects of the draft can be solved through the open managers’ commitment,the diversification of the supervision and the improvement of the punishment.
