摘要
民族商事习惯定位于"习惯"本体,本质为商事性专业属性,特殊性为民族性属性,在没有改变"习惯"本体和商事属性的前提下,重点突出"身份标志",有效地将"习惯"、"民事(商事)习惯"和"民族性"融合为和谐的整体,成为民族习惯、民事习惯和商事习惯的升级版,自带或者蕴涵着诸多属性特征:习惯规则定位本位属性特征,商事习惯确立主体性特征,民族习惯显现标志性特征,诚信善良奠立道德价值特征,国际商事惯例借鉴出类比特征,商事价值重点突出专业属性特征。
Ethnic Commercial Custom origintes from custom. Its essential attribute lies in commercial nature, special attribute lies in ethnic nature, and comes with some lagal characteristics. It changes neither "custom" nature nor commercial nature nor traditional characteristics; It highlights "identity", and is treated as special marks of "habit" and "civil(commercial) custom", it even becomes the upgraded version of ethnic custom. This paper argues that rules of custom macroscopically exhibite abstract legal characteristics, commercial custom provides general characteristics, ethnic custom establishes special characteristics, sincerity and goodness upgrade moral features, international commercial custom draws some analogy features, and commercial value builds core characteristics.
