生育权保障视野下代孕的合法化研究

生育权是一项基本人权,随着社会的不断发展,生育权受到了来自多方面的侵害。代孕技术的成熟为生育权的实现提供了一个崭新的出路,但因现行法律禁止代孕行为,使得代孕沦为地下利益交易的工具。代孕合法化不但可以保障特殊群体生育权的实现,还体现了自然人对身体的支配权,顺应了公序良俗的发展趋势。合法代孕应采取无偿完全代孕的形式;相关主管部门应对代孕参与双方的资格进行严格审查,以防止代孕被滥用;同时对代孕参与双方的权利义务进行明确规定。

The right to procreate is a basic human right. With the continuous development of society, it has been attacked from many aspects.The maturity of surrogacy technology provides a new way for the realization of reproductive rights, but because of the existing laws prohibiting surrogacy, the surrogate becomes a tool for underground interest trading. The legalization of surrogacy not only guarantees the realization of the right to procreate of special groups, but also embodies the natural person＇s right to dominate the body and conforms to the development trend of public order and good custom.The legal surrogate should take the form of free complete surrogacy; relevant departments should strictly investigate the two sides involving in surrogate to prevent abuse of surrogacy; meanwhile, provisions on the rights and obligations of both parties involved in surrogacy should be cleared either.
