我国体育用品供给侧协同创新的法律保障研究

Legal security of supply-side collaborative innovation for sports goods

体育用品协同创新包括契约、合伙和股份三种协同模式,在经济关系保障、知识产权管理以及协同创新公共服务平台建设三大方面需要系统的法律保障措施。从三大法律基础问题入手,以国家相关法律条款为解释依据,提出:经济关系保障问题包括契约形式法律保障和公司形式保障形式;知识产权保障问题包括知识产权的市场价值评估、交易与转化保障、横向课题以及科技研发人员人事管理三方面;协同创新公共服务平台包括纵向课题管理、金融财税政策、体育用品技术标准管理三大方面。

There are 3 modes for sports goods collaborative innovation,including： contract,partnership and share. Systematic legal security measures are needed in economic relations,intellectual property management and collaborative innovation public service platform construction. Starting from the 3 basic legal issues and based on relevant state legal provisions,the paper puts forward that economic relationship guarantee includes contract form as legal guarantee and company form guarantee;intellectual property security include three parts： market value assessment,trade and transformation,crosswise project and the scientific and technological research and development personnel management; collaborative innovation public service platform includes three aspects： longitudinal subject management,finance and taxation policy,and technical standard management of sporting goods.
