废除卖淫嫖娼收容教育立法的建议

Legislation Proposals on Repealing Prostitution Asylum Education System

收容教育制度的初衷,是为了教育、挽救卖淫嫖娼人员,制止性病蔓延,对其集中进行法律、道德教育,组织参加生产劳动以及进行性病检查及治疗。但着眼现实,收容教育实施现状并不乐观。实施程序缺乏公开、透明、可救济的法治精神,适用条件不够具体明确、弹性空间太大,未能实现立法初衷,故应对其存在的合法、合理性予以深入探究。从其存在的合法性来看,《卖淫嫖娼人员收容教育办法》在本质上违反《宪法》《立法法》《行政强制法》《行政处罚法》以及《治安管理处罚法》,惩罚力度也严重违反了比例原则这一基本法治原则,不合法治国家要求。从其存在的合理性来看,卖淫嫖娼行为是任何历史阶段和社会形态都存在的一种社会现象,并且在任何社会形态下都没有办法真正禁绝。我们有必要重新审视卖淫嫖娼行为,思考其到底是否应当受到法律的制裁。我国对于卖淫嫖娼行为的规制在《刑法》以及《治安管理处罚法》都有所规定,已然形成了严密的处罚体系。因此,对于这部"既不好,又不管用,不能解决问题"的《卖淫嫖娼人员收容教育办法》,建议应当明确废除。

The original purpose of asylum education system is to educate and save prostitutes and whoremongers, to prevent the spread of venereal diseases, to give concentrative and moral lessons to them and organize disease inspections. But the operation of this system did not go well in reality. The implementation lacks transparency, and the spirit and principle of the rule of law; the application conditions are not specific enough and have loopholes, so asylum education system does not live up to the original expectation. It is necessary to do more researches on the validity and rationality of the system. From the perspective of validity, Measures for the Detention Education of Persons Engaging in Prostitution and Whoring goes against the Constitution, the Legislation Law, the Administrative Compulsion Law, Law of The People＇s Republic Of China on Administrative Penalty and Public Security Administration Punishments Law. The principle of proportionality does not embody therein as well, which is not appropriate as a country under the rule of law requires. From the perspective of rationality, prostitution cannot be rooted out in any society under any circumstance. So it is necessary for us to rethink the prostitution problem and contemplate on the question whether it should be punished.There are several laws and regulations govern this issue in our country like Criminal Law and Public Security Administration Punishments Law, which have constituted a penalty system altogether. It is strongly suggested that Measures for the Detention Education of Persons Engaging in Prostitution and Whoring be repealed due to so many disadvantages on different aspects thereof.
