摘要
当前,各级法院特别是基层法院推行法官员额制,亟需大量法官助理人才,基于此,湖南人文科技学院法学院与娄星区法院在全省率先建立法官助理联合培养机制。在该机制中,校院双方通过"双渠道"联合进行应用型法律人才的培养,法院提供人才需求机会和实践教育场所,优秀法官全程参与法官助理的培养,高校与司法实务部门建立有效的合作关系,实现法学专业人才供需关系的紧密结合。法官助理联合培养机制具有优化法学专业人才培养方案;推进校院协同创新育人机制;引领和服务司法改革;大学生"未毕业先就业"等优势,但仍面临:法官助理实习的延续性;"临聘型"法官助理身份的模糊性;法官助理制度的倒逼性;法官助理的职业预期性等问题的挑战。
At present,all levels of courts,especially local courts,need a large number of judge assistants because of the implement of judge personnel system. As a result,a joint training mechanism of judge assistants in Hunan Province has been established in advance by the School of Law of HUHST and the People's Court of Louxing District. In this mechanism,both sides raise up applied legal talents through the'dual-channel'joint personnel training. The court provides opportunities and practice sites for the talents; excellent judges of the court take part in the whole-course training of judge assistants. The university and the judicial department have established an effective cooperation relationship in order to form a close knot between supply and demand of legal professionals. The joint training mechanism of judge assistants has the advantages of optimizing the legal professional training program,promoting the collaboration of universities and courts,guiding and improving the judicial reform and having students employed before graduation. But the challenges exist at the same time,e. g. the ambiguity of the judge assistants' identification,the counterattack of the judge assistant system,the career expectation of judge assistants,etc.
