摘要
刑法条文中一些与非近亲属(1)关系有关犯罪的定罪量刑整体上有轻缓化倾向,这有其内在的刑罚理论基础与现实的刑事政策依据。在宽严相济刑事政策之下,与非近亲属有关的关系范围和涉及的犯罪类型有扩大的可行性。对此应持谨慎态度予以科学扩充。
The developing trend of punishment is the mitigation of sentencing between non-relatives overall criminal law. There are theoretical basis on punishment and criminal policy reference. Under the criminal policy of coming punishment with leniency,it is practical to extend the range of non-relatives and crime types.Such extension should be taken place with a prudent and scientific attitude.
