监督制约行政权力是法治建设和行政体制改革中永恒的话题。行政机关或行政人员违法或滥用行政权力,不仅损害公民、法人的利益,还会破坏统一的经济社会秩序和法律秩序,给社会的发展带来具有破坏力的负效应。有效限制行政机关或行政人员滥用行政权力,是新常态下维护公民、法人合法权益和国家发展利益,提高治国理政水平,完善社会主义民主与法制建设,加大反腐倡廉力度不可或缺的重要内容。文章探索了监督制约行政权力面临的问题,并提出了有价值的对策性建议。

To supervise administrative power is a constant topic for the practice of legal construction and administrative system reform. Violation of law or power abuse, by the administrative institution or staff, not only harms the interest of the citizens and legal representatives but also disunities the economic social order and legal order,and hence brings negative effeet to so- cial development. An effective practice of constraining their power abuse is an important con- tent for China to promote political management and protect the citizen and legal representative＇ s legal right,which is also the main eontent of improving social democracy and legal construetion and anti-corruption combat. The problems are discussed to provide valuable suggestions for policy making.
