摘要
我国农地开发权本质就是国家赋予农村土地使用者改变耕地用途的权利,农地开发权可以独立于集体土地所有权而存在。城乡和区域人口流动引起农地开发权供求错配,农地开发权供求调节机制必须适应主体功能区规划要求,皖江城市带重点开发区与带限制开发区之间农地开发权供给严重失衡。当前,应完善城乡建设用地增减挂钩试点制度、建立农地开发权收购和储备制度、实行皖江城市带农地开发权跨区域交易制度。
The essence of farmland development right is to give the rural land users the right to change the use of the cultivated land. The development right of farmland can be independent of the owership of collective land. Urban and rural population movement causes the mismatch between supply and demand of agricultural land development rights. The regulation mechanism of the supply and demand of agricultural land development rights must meet the planning requirements of the main functional areas, and the supply of agricultural land development rights between the key development zones and the restricted development zones in the Wanjiang urban belt is seriously out of balance. At present, urban and rural construction land should be improved and linked to the pilot system, the establishment of farmland development rights to acquire and reserve system, the implementation of the cities of Anhui Province with the right to cross regional agricultural land transaction system.
