制度的内生性表明,法官从心理上追求审判独立是审判独立制度运行的重要条件。从黑格尔"他者"理论引申出法官追求独立审判心理与审判外干扰因素的对抗,法官心理上追求审判独立因素在与作为"他者"的关系主义、政治正确、社会焦虑的对抗之中褪变为无本质、工具性存在,是法官独立审判制度运行不畅的重要原因之一。法官心理中追求审判独立因素的"自我意识"强化,成为主体性、本质的存在,对于促进审判独立制度的内生具有重要意义。

The Hegelian theory of'the other'draws out the confrontation between the judge's pursuit of the independent trial and the extraneous interference factors.The judge's psychological pursuit of the independence of the trial is confrontation with the relativism,political correctness and social anxiety which are treated as 'the other'.This is one of the important reasons why the judge's independent trial system is not running smoothly.The 'self-consciousness'in the pursuit of the independence of trial judges being strengthened and becoming the existence of subjectivity and essence is of great significance to promote the independence of trial independence system.
