法律移植具有丰富性、高效性、创新性,能够满足经济高速发展的要求。法律移植的成功与否在于法律本土化,因此研究者需要理解国外的法律和背景,其中难点在于外国法律解释材料的取舍。美国法的法律材料分为权威性参考材料、非权威性参考材料、禁止参考材料。前两者是研究美国法必须参考的资料,后者可以不查阅。

Legal transplantation is rich,efficient and innovative,which can meet the requirements of rapid economic development. The success of the legal transplant lies in the localization of the law,so the researchers need to understand the foreign law and its background,of which the difficulty lies in the choice of foreign legal interpretation of materials. The legal material of American law is divided into authoritative reference material,non -authoritative reference material and prohibited reference material. The first two are the materials that must be consulted in the study of American law,and the latter one can not be consulted.
