网络空间的法律地位与法律保障

A Brief Introduction of the Territorialisation of Cyberspace:From the Perspective of International Law

[目的/意义]由于互联网技术的不断发展,网络空间承载的公民日常行为活动越来越多,国家对于网络空间的依赖也逐渐加深,需要国家正视和完善网络空间的法律地位和法律保障。[方法/过程]通过对实体空间内国家主权和领土概念的深入研究,结合目前网络空间中法律行为的现实表现形式,对网络空间的主权化进行分析。[结果/结论]网络空间目前正处于主权化的进程中,网络空间的主权化权利需要在承认差异的基础上,谋求等同于实体空间的法律地位和法律保障。

[ Purpose/Significance] With the continuous development of Internet technology, the network space of citizen＇s daily activities is becoming larger, and the dependence on cyberspace is gradually deepening, so more and more countries need face and perfect the legal status and legal protection of network space. [ Method/Process] Based on national sovereignty and territorial entity space concept of in-depth study, combining the reality of the legal behavior in network space form, the cyberspace sovereignty process were analyzed. [ Re- sult/Conclusion] In the process of network space which is now on its sovereignty, the sovereign rights of the network space needs to ac-knowledge differences, on the basis of seeking the same thing as entity space legal status and legal protection.
