Research on Binary Patent Quality

[目的/意义]专利质量是评价被专利保护技术方案价值的重要指标,高质量的专利对社会经济发展和技术进步发挥着重要作用。[方法/过程]根据专利权人为获得经济回报和法律保护的目的,将专利质量分为经济质量和法律质量,通过生命周期理论、规模效应理论、风险分散理论等对经济质量和法律质量进行研究。[结果/结论]研究发现,二者之间既有独立性又有相关性。二者在专利生命周期中产生、终结的时间,以及在各个阶段的功能和重要程度并不相同。专利战略使得专利作为个体和组合所表现出的经济质量和法律质量之间的关系也有所区别。

[ Purpose/Significance] Patent quality is the important index for assessing the value of the patented technology. Patent quality is very important to develop society and economy and advance technologies. [ Method/Process] In accordance to the patent holders inten-tions for obtaining economic return and legal protection, this article divides patent quality into economic quality and legal quality. This ar-ticle analyzes economic quality and legal quality through the life cycle theory, scale effect theory and risk diversification theory. [Result/ Conclusion ] The relation between economic quality and legal quality is both independent and related. The generation and end, function, as well as importance of both in the different stages of patent life cycle are different. Meanwhile, patent strategy makes somewhat difference on the relationship between economic quality and legal quality when patents are seemed as the individual or a portfolio.
