新型城镇化背景下农村妇女土地权益问题研究

当前农村妇女土地权益受侵程度严重,具体表现为不同婚姻状态妇女的土地承包经营权、宅基地分配权和集体收益分配权受损。究其原因,主要是新型城镇化建设带来土地利益博弈、村规民约和村民自治的制约、法律法规缺乏整体性和可操作性以及传统父权制根深蒂固的影响。因此,提出必须完善农地"三权分置"办法,完善立法、公平执法,多方协作,同时培养妇女维权意识等对策。这将有利于保护农村妇女土地权益,推动新型城镇化的健康、有序发展。

The current degree of land rights and interests infringement is more serious, specifically in contractual management rights, homestead distribution rights and collective income distribution rights for the different marital status of women. The main reason lies in the land benefit game, the village regulations and the villagers' autonomy, the lack of integrity and maneuverability of the laws and regulations, and the profound influence of the traditional patriarchy brought by the new urbanization construction. Therefore, the necessity to improve and perfect the agricultural land 'three rights split' approach, to improve the legislation and law enforcement, multi-collaboration, while fostering women's awareness of right maintenance was proposed, which would be beneficial for protecting the land rights and interests of rural women, to promote a healthy and orderly development of the new urbanization.
