Study on Development of Socialism Theory with Chinese Characteristics and Theoretical Innovation of Social Law——Taking Xi Jinping's Speeches on Socialism with Chinese Characteristics as a Guideline

社会法基本理论研究的根本问题是"根据"问题,仅仅根据西方理论,会导致社会法的研究出现目标不明、立场不清和思路混乱,因此应当根据当代中国特色社会主义理论来展开研究。首先以当代马克思主义为根基,使社会法坚持以广大劳动人民群众利益为本;其次以中国特色社会主义道路为指引,着重在社会公平领域特别是"共建共享"的社会法要义方向展开研究;再次随着中国特色社会主义理论内容的丰富和发展,展开"社会权利本位论"的创新研究。

The fundamental problem of the basic theory of social law is the problem of its basis. Only taking western theory as its base will lead to confusion in goal, position and thought of social law research, so it should be based on contemporary socialism with Chinese characteristics. First of all, it should be based on contemporary Marxism, making social law secure the interests of the working people. Then the research should focus on social justice, especially the “combination of construction and sharing”, with the guideline of socialism with Chinese characteristics. At last, the innovative “social-right-oriented” research should be carried out along with the enrichment and development of the theoretical content of socialism with Chinese characteristics.
