提及"保证非会员国遵守上述义务原则",多是作为联合国的非会员国义务来分析的,是"条约对第三国无损益原则"的例外。然该原则并无约束非会员的法律效果,仅仅在和平与安全的范畴内对非会员施加了一种影响。这种影响与其说是来源于条约或国际习惯法效力,不如说是来源于国际强行法和国际组织的固有和隐含权利。同时,这一原则的落实有赖于集体协助原则。

When we refer to'the principle of assurance of non-member states to comply with the above obligations',it is always parsed as obligation of non-member states of the United Nations and an exception to the principle of'pacta tertiis nec nocent nec prosunt'.However,this principle does not have the legal effectiveness on the non-member states,only have some influences on the non-member states in the context of peace and security.These influences do not derived from treaties or international customs,but come from international jus cogens and inherent and implied rights of the international organizations.Meanwhile,the implementation of this principle depends on the principle of collective assistance.
