指导性案例的功能是基于其准法源地位所固有的内部效能。该功能在具体司法中细分为清晰法律、补充法律、弥补漏洞和创设规则等四个方面,并因各自侧重点不同而对应不同的案例类型。当前,指导性案例功能实现主要存在立法与指导性案例衔接不当、重条文轻案例、重裁判结果轻裁判标准三大难题。对此难题,通过制度保障确立指导性案例的司法权威,深入挖掘案例的裁判规则,重视司法过程中的法律方法运用,可以作为难题解决的基本思路。

The function of the leading case is based on the inherent internal efficiency of the quasi-legal source status.The specific application can be divided into four： clear law,supplementary law,closing loopholes and creating rules,and because of their different emphases,they correspond to different case types.At present,there are three major problems in the implementation of the current leading case function,such as improper linking of legislation and leading cases,heavy provisions light case,heavy judge result light judge standard.To this problem,through the institutional guarantee to establish judicial authority of leading cases,in-depth excavation referee rules of the case,pay more attention to the application of legal methods in judicial process should be as the basic train of thought of solving the problem.
