摘要
本文从对劳动合同法的相关条款进行修订的视角出发,以企业用工自主权为切入点,分析现行劳动合同法的实施对中小企业发展的影响,紧扣动态性、开放性的时代特点,提出制约中小企业生存发展的瓶颈因素,并以劳动合同法修订为契机,提出立法修改的新思路及解决当前中小企业发展的新举措。
In this paper, from the perspective of amending the relevant provisions of the labor contract law , taking the employ -ment autonomy of enterprises as the breakthrough point, the impact of the implementation of the current labor contract law on the development of SMEs is analyzed . It closely linked to the dynamic and open characteristics of the times, and put forward the bottleneck factors restricting the survival and development of SMEs . Finally , this article takes the revision of labor contract law as a turning point, puts forward new ideas of legislation revision and new measures to solve the current development of SMEs .
