摘要
哈萨克斯坦新劳动法典诞生于其经济局面受全球经济危机影响而持续恶化之际。该法以自由主义为导向,引入或重塑了涉及竞业禁止协议、劳动者责任、劳动合同、试用期等问题的一系列重要制度,表现出强烈的危机意识和坚定的改革立场,必将对哈萨克斯坦未来的经济发展产生深远的影响。我国与哈萨克斯坦同属经济转型期国家,我们应当挖掘哈萨克斯坦新劳动法典的借鉴价值,推动我国法治实践向符合时代要求的方向不断发展。
The new Labor Code of Kazakhstan was born in the time when the economy of Kazakhstan, affected by global economy crisis, deteriorates continuously. Guided by liberalism, this law introduced or shaped a series of important institutions related to noncompetition agreement, labor responsibility, labor contract, probation and so on, showing the strong sense of crisis and the firm stand of reform, and will have far-reaching impact on economic development of Kazakhstan in future. Like Kazakhstan, China also is a country experiencing economic transformation. We should explore reference value of new Labor Code of Kazakhstan, and promote continuously our law in direction that meets requirement of times.
