摘要
我国的《劳动法》《劳动合同法》《女职工劳动保护特别规定》《妇女权益保护法》《社会保险法》对女性孕产期保护、劳动强度都等有相关规定。但是,随着二孩政策的全面实施,女性就业权益保护就面临着新的问题,如因生育导致女性就业更为艰难,高龄孕产妇的特殊保护不足,生育保险水平低,生育福利缺失,生育救济不够等。要真正贯彻人口发展战略,全面实施二孩的政策,需要在法律和政策上不断去完善这些制度。
China's Labor Law, Labor Contract Law, Special Provisions on the Protection of Labor for Female Workers, Law of China on Protecting Women's Rights and Interests, Social Insurance Law have certain provisions on the protection for women in pregnancy and labor intensity, etc. But after the implementation of a comprehensive two -child policy, the protection of women's employment right faces new problems, including that women's employment becomes more difficult, the special protection for elderly pregnant women is insufficient, birth insurance level is low, fertility benefit is not efficient, fertility relief is not enough and so on. To truly implement the population development strategy and fully implement two-child policy need to continue to improve the system from law and policy.
