少数民族传统文化信仰与现代法制化建设的冲突与融合

The Conflict and Intermingle between the Traditional Cultural and Beliefs of Ethnic Minorities and the Construction of Modern Legal System

少数民族传统文化信仰在我国与现代化法治建设存在的冲突与我国少数民族数量、人口、分布和历史问题息息相关,这也是使得我国少数民族问题区别于其他国家的重要特点。基于对上述问题的分析,提出了有针对性地帮助少数民族传统文化信仰与现代化法治建设融合的三点建议,即走合作而非移植或替代路线、积极促进少数民族对现代法律的内发性需求,以及始终如一贯彻党和政府关于尊重少数民族习俗和宗教信仰的民族政策。

The traditional culture and beliefs of ethnic minority in china are in conflict with China＇s construction of modern legal system, the exist of this conflict in China is closely related to the variety、population, distribution, and historical issues of china＇s ethnic minority, this is an important characteristic of the ethnic minority issues in our country which makes the difference from other countries. The analysis based on the above key points,this paper give out three suggestions which may help intermingle the conflict between traditional culture and beliefs of ethnic minority in china and the construction of modern legal system, including encourage cooperation rather than simple transplantation of modern legal system, promote the demand of of modern legal system the minority society, and stick on the respect ethnic customs and religious beliefs national policy.
