在当下中国社会,公民的道德困境成为一个敏感又深刻的话题。早些年的"小悦悦事件",近来层出不穷的"彭宇案"时时刻刻刺痛着国民的神经。道德和法律的冲突在个人荒谬的行为上表现的十分突出,在法治中国的大背景下,显得格格不入。基于社会学视角,通过对此类社会现象的考察,从法律规范和自身修养两个角度进行分析,法治社会的建立不仅仅在于法律法规的完善,同时也有赖于国民个人修养的提升。法律规范与自我修养相互促进,彼此限制的矛盾关系在一定程度上影响着我国法治社会的进程。因此,在法治建设快速发展的同时,公民的自身修养也应得到重视。否则,就算再完备的法律,也缺乏法治的实质意义。

In contemporary Chinese society,the moral dilemma in the face of our citizens has become a hot and sensitive topic. The famous 'Xiaoyueyue'news and 'Peng Yu'case has always made people feel hurts.The conflict between the law and morality is prominent against the back drop of rule of law. The establishment of a rule-of-law country needs not only the improvement of laws and regulations,but the promotion of individual morality. The mutual enhancement and restriction between law regulations and individual morality affects the progress of the establishment of a rule-of-law country. Accordingly,individual morality shall be stressed while we press ahead with legal cause.
