An Analysis of Patent Commercial Operation Pattern

摘要 我国专利商业运营模式尚处于起步阶段,在数量和质量上都与欧美等发达国家存在一定的差距,我国专利运营模式更多的是企业、高校等独立地进行知识产权管理。借鉴国外先进专利商业运营模式,有助于加快我国专利商业运营模式的建设和发展,挖掘高校、研究机构、企业、个人等潜在的技术供给方,寻求企业等潜在的技术需求者,对实现专利市场化具有重要意义。利用德温特数据库Derwent Innovations IndexSM检索的国内外专利数据,着重分析了我国天津滨海国际知识产权交易所、北京知识产权运营管理有限公司、智谷公司等专利运营模式;以大连理工大学的专利数据为例,分析我国高校等纯研发性组织的专利成果转化;在企业专利商业运营方面主要分析了华为公司的专利战略, China's patent commercial operation pattern is still in its infancy.Compared with Europe,the US and other developed countries,there is a gap in terms of quantity and quality.China's patent commercial operation pattern is more about enterprises and universities.By learning from the advanced patent commercial operation pattern,we can construct and develop patent commercial operation pattern of our country more efficiently,mining potential patent suppliers,and seeking the potential technical needs.Based on the domestic and foreign patent data retrieved by Derwent Innovations IndexSM,the paper analyzed the patent commercial operation pattern of Tianjin Binhai International Intellectual Property Exchange,Beijing Intellectual Property Management Co.,Ltd.and Zhigu Company.Taking the patent data of Dalian University of Technology and Huawei's essential patent for 5G communication as examples,the paper analyzed the patent transformation of universities and other R&D organizations,and Huawei's patent strategy.By the analysis of the four patent commercial operation patterns of intellectual property transaction platform,NPEs,scientific institutions and enterprise and the combination of policy and marketing environment,the paper offered suggestions to R&D,personnel training,patent management and so on,which is significant for the construction and development of China's patent commercial operation pattern.
