摘要
地处北京市北部的昌平区、怀柔区、延庆县(现为区)三个远郊区县政府先后实施了对外地号牌车辆的限行措施,引起了舆论场的分野,亦存在法理上的短板。行政措施的合法性直接影响到政府社会管理的正当性。在十二届全国人大三次会议通过了《立法法》修正案,对地方政府规章的相关问题做出了新规定的背景下,区县级地方政府车辆限行措施中存在的法律问题更有进一步探讨的必要性和紧迫性。针对三个远郊区县对车辆限行措施的分析,发现了立法目的和上位法依据方面的欠缺,以及限行措施及其上位法的内容与行政法基本原则的抵触之处,并结合现实提出了相应的对策建议,以期实现政府对社会公共事务的有效治理。
In order to improve the traffic condition and air quality in Beijing,Changping district,Huairou district and Yanqing county(district now),which located in Beijing outer suburban area,have implement restriction measures to nonlocal vehicle traffic,which arouse controversy in some scale and degree,and a short board in Jurisprudence.The 12th National People ‘s Congress meeting passed the Legislative Law amendment which set Issues related to the local governments' regulations.The legitimacy of administrative measures directly affect the legitimacy of the government's social management.under the background of the legislative law has been modified,there are some legal problems of the vehicle limit measures of the county level local government.This text takes Beijing as an example,to analyse these questions:the deficiency of legislative purpose of vehicle restriction measures,the host law is illegitimate,the contents of the restriction measures and the higher rank law violate the basic principles of administrative law,and put forward the corresponding countermeasures and suggestions,in order to realize the effective administration of the government to the social public affairs.
