建国后我国职务犯罪侦查权之历史沿革及监督构想

Historical Evolution and Supervision Conception of Investigation Power of Duty Crime in China Since the Founding of PRC

职务犯罪侦查权自新中国成立以来就由检察机关行使,只是在不同的历史时期管辖范围出现扩大、缩减的变化而已。2016年12月,党中央确定在北京市、山西省、浙江省开展国家监察体制改革试点,设立监察委员会以整合反腐资源,加强反腐力度,提高反腐效能,检察机关行使近70年的职务犯罪侦查权面临易主。由于公权力的强制性和扩张性,任何公权力都极易侵害私权利,无论职务犯罪侦查权"花落谁家",加强对其监督制约、规范其行使才是永恒的主题。通过对建国后检察机关职务犯罪侦查权管辖之归属、范围及制约的历史梳理,提出了对该侦查权的监督构想,以期对我国职务犯罪侦查权的配置有所裨益。

The investigation power of duty crime has been exercised by the procuratorial organ since the founding of new China,but it has only changed and expanded in different administrative jurisdictions in different historical periods.In December 2016,the CPC Central Committee decided to launch the pilot reform of state supervision system in Beijing City,Shanxi Province,Zhejiang Province,set up a commission to the integration of resources and corruption,strengthen anti-corruption efforts,improve the effectiveness of anti-corruption,the procuratorial organs to exercise the nearly 70 years of job-related crimes investigation of the right to face change.Because of the coercive and expansionary nature of public power,any public power is liable to infringe upon private rights.The duty of crime,the power of investigation and the ' family of flowers' are the eternal themes.By ownership,after the founding of the procuratorial organs duty crime investigation jurisdiction scope and constraints of the history,put forward the conception of the supervision of investigation power,in order to benefit our country duty crime investigation right configuration.
