论关联行政行为违法性继承的司法审查规则

On the Judicial Review Rules of Succession of the Illegality of Associated Administrative Actions

行政主体的行政行为必须具备一定的公定力与确定力,行政职能的目标才能有效达成,但同时公民私权需要尽可能得到保护与救济,因此行政主体行政行为的公定力与确定力应受到必要的监督与限制。关联行政行为的违法性继承是对行政机关行政行为公定力与确定力的突破,然而关联行政行为的违法性审查在司法实践中存在价值冲突、同案不同判等问题。对此应在冲突背后寻求价值平衡,寻求关联行政行为的违法性继承的共识,并提出相应司法审查思路,藉此以推动对关联行政行为违法性继承的司法审查,对其违法性继承作出有效认定,从而为破除司法实践困境提供有益参考。

The administrative actions of administrative bodies should have authority and definiteness which enable the achievement of administrative objectives, while citizens＇ private rights require protection and remedies as far as possible. Hence the authority and definiteness of administrative actions should be under necessary supervision and limitation. The succession of the illegality of associated administrative actions is a breakthrough of administrative actions＇ authority and definiteness. However, there are conflicting values and inconsistent judgments on a same case in the practical judicial review of the illegality of associated administrative actions. Under the circumstance of conflicts, this paper is aimed to pursue balance tween different values and consensus upon the succession of illegality and to put forward corresponding perspectives of judicial review, by which the judicial review and valid approval of the succession could be promoted. Subsequently, the dilemma of judicial practice could be alleviated upon such beneficial references.
