“冒充司法人员实施电信诈骗”犯罪的防控对策研究——以临沂市经济开发区为例

On the Preventive Countermeasures to Telecom Fraud in the Name of Legal Staff——Take Linyi Economic Development Area as Example

"冒充司法人员实施电信诈骗"犯罪较之普通电信诈骗犯罪有着自身独有的发生原因,如用以实施"诈骗剧本"专业性强,人们法治思维尚未牢固以及法律常识的欠缺等。因此对于"冒充司法人员实施电信诈骗"犯罪应当分而治之,有针对性地提出防控对策,如对撰写"诈骗剧本"者也应当按共犯处理,借鉴抢劫罪中将"冒充军警人员抢劫"的行为作为抢劫罪的法定刑升格条件,将"冒充司法工作人员"的行为作为法定刑升格条件而非一个量刑情节,加强技术层面的监管,司法部门应采取相应配套措施以及加强国际间多样化的合作等。

Compared with common telecom fraud,telecom fraud in the name of legal staff has its self-exclusive causes such as strong specialty in fraud script,weak legal thinking of the people and deficiency of legal knowledge. So telecom fraud in the name of legal staff should be divided and ruled. The writer of fraud script should also be punished as accomplice. The behavior of telecom fraud in the name of legal staff should be seen as conditions for the statutory penalty not as a sentencing circumstance borrowing from robbery which regards the behaviors of robbery in the name of military officers as conditions for the statutory penalty. The supervision on technology should be strengthened. Judicial departments should take corresponding measures and strengthen international and diversified cooperation.
