对“入户抢劫”中抢劫行为发生地点的探究

Exploration on the Places of Robbing in Robbery of Housebreaking

抢劫罪因取财顺序的不同分为先压制后取财的普通抢劫罪与先取财后压制的转化型抢劫罪。"入户抢劫"对抢劫行为发生地点的要求因抢劫行为的分解和顺序的变化而变得复杂,压制行为在户内取财行为在户外、压制行为在户外取财行为在户内是否构成"入户抢劫",应考察两个方面:一是抢劫行为是否侵犯"入户抢劫"新增"入户"加重要素所保护的法益——个人生活的安宁与公众对私密空间不受侵犯的信赖感与安全感;二是是否满足"入户抢劫"形式构成要件。成立"入户抢劫"包括其未完成形态,入户时有抢劫的不确定故意,压制行为在户内取财行为在户外时,属于抢劫罪的既遂而"入户抢劫"的未遂;压制行为在户外取财行为在户内时,不构成"入户抢劫"。

According to different property robbing sequence,crime of robbery includes common robbery which is to suppress first and rob property then and transformed robbery which is to rob property first and suppress then. The demand on places of robbing in robbery of housebreaking becomes complicated because of the decomposition of robbery behaviors and the change of sequence. Whether indoor suppressing and outdoor robbing,indoor robbing and outdoor suppressing could constitute robbery of housebreaking should be researched from 2 aspects： first,whether the robbing behavior infringes the legal interest that housebreaking aggravates to protect-peace in everyone＇s living and the sense of trust and security that the public＇s private space could not be infringed; second,whether it meets the formal constitutive element＇s of robbery of housebreaking. The formation of robbery of housebreaking includes its unfinished form,uncertain intention of robbery when breaking into the house,indoor suppressing and outdoor robbing is complete robbery and incomplete robbery of housebreaking. Outdoor suppressing and indoor robbing is not robbery of housebreaking.
