摘要
商品房买卖合同"验收"条款因当前商品房领域法律法规及相关红头文件规定的交织混乱,致使司法裁判对"验收"的标准及法律适用存在争议。"综合验收"客观形式从审批制改为备案制,并非意味其标准的取消及法律强制力的失效,"四方验收"作为建设工程合同纠纷的标准在未对商品房买卖合同约定详细区分下即取代"综合验收"系属法律适用错误。为更好规范商品房交易市场,维护购房者权益,最高院出台相应指导意见,房产部门监督和推进新版《商品房买卖合同示范文本》及国务院加快修订相关法规规章已成为解决问题的当务之急。
Currently,laws and regulations and the regulations of relevant red-head documents about commercial house sales contract"acceptance"clause are mixed and confused,resulting in the judicial adjudication on the standard and legal applications of" acceptance" has a dispute. The transformation of the objective form of" comprehensive acceptance" from examination and approval system to filing system does not mean the abolition of its standards and legal compulsion loses efficacy. As the standard of construction project contract dispute,in the case that it hasn't distinguished commercial house sales contract appointment in detail,the"four-party acceptance"replacing" comprehensive acceptance" is a legal application error. To better regulate the commercial housing market,and to protect the interests of house buyers,the supreme court should introduce corresponding guidance,the real estate sector should monitor and promote the new version of"commercial housing sales contract model text"and the State Council should speed up the revision of relevant laws and regulations,which has been the top priority to solve the problem.
