法律视域下农村集体土地的“三权分置”

摘要 实行农村集体土地所有权、承包权和经营权"三权分置"是实践探索的产物,但我国立法并不能提供有力的制度保障。将作为用益物权的土地承包经营权分为承包权和经营权,并不意味着承包权和经营权也是用益物权,将经营权界定为经营性债权更为符合法律逻辑,不违背一物一权的物权法基本原则,更能体现意思自治原则。经营权不能成为抵押权客体,作为质权客体更为适宜。农村集体土地"三权分置",应在法律体系内规范其内涵,构建合理的权利体系,切实保障农民的合法权益。 "Three Rights Separation",which means the separation of rural collective land ownership,contract rights and management rights,is the product of the practice.But our legislation can not provide strong institutional guarantee.As a usufructuary rights,land contractual management is divided into the rights to contract and management,does not mean that the contract rights and management rights are also usufructuary right.The management rights is defined as operating rights of contract,which is not only conform to the logic of law but also cohere with the basic principles of property law.Besides,this method respect the principle of autonomy of the contract parties.Management rights cannot become the object of the right of mortgage.As the object of pledge is more suitable,the connotation of"Three Rights Separation"of the rural collective land should be standardized in the legal system and formulate the reasonable rights system.What's more,effective measures must be taken to protect the legitimate rights and interests of farmers.
