Tracing the Origin of Chinese Contemporary Legal Document Terms——Inherited the Traditional Part

法律文书名词的研究,具有重要的法学及文书学、档案学意义,但目前相关研究尚处于空白状态。我国当代法律文书名词分别来源于继承、移植和自创,文章研究内容为继承部分,包括古代与近代法律文书名词继承两个方面。源于古代和近代的法律名词在当代法律文书名词体系中多为基础性名词并常出现在诉讼程序中,随着法制的不断发展,现今基于这些名词衍生出一些法律文书词语,逐渐形成枝状系统。

The research of legal document nouns has significant in law,document and archival science,but its specific research is still in blank. The legal document nouns in present China are respectively from inheritance, transplantation and self-creation.This paper is about the inheritance part, including the ancient and modern legal document nouns.These nouns are majority fundamental and commonly used in the system of legal document nouns, mostly appeared in the proceedings and be known to the public.With the development of the contemporary legal system, some legal document words that based on these nouns is generating and gradually form a dendritic system.
