论刑法上典型异样因果形态的因果关系特别判断

介入因素所致因果流程上的典型异样形态,是超越因果关系与假设因果关系的。条件关系并相当关系可以成为普通场合下刑法因果关系判断的基本规则,但是在异样因果流程的刑法因果关系判断中,这一基本规则的完全适用将会遇到问题。因此,需要构建"因果关系断绝"的概念,来具体诠释超越因果关系中超越原因之外的另一原因力的条件关系判断。应当将"现实充分条件"公式作为一般条件关系公式的补充,从而为假设因果关系中条件关系的判断提供理论支持。

Therefore, the concept of ＂causal relationship break＂ should be constructed to explain the cause force in beyond causality other than beyond reason. ＂sufficient condition＂ should be a supplement of the general conditions, so as to provide theoretical support of the causation test in hypothesis causality.
