深圳市南山区2013—2016年卫生行政处罚案件情况分析

Analysis on the cases of health administrative penalty dealt at Shenzhen Nanshan from 2013 to 2016

目的分析深圳市南山区2013年11月—2016年10月三个考核年度的卫生行政处罚案件情况,为提高卫生行政处罚案件质量,改进卫生计生监督执法工作提供参考。方法对2013年11月1日—2016年10月31日,深圳市南山区卫生监督所办理的卫生行政处罚案件进行全面分析。结果深圳市南山区的卫生行政处罚案件选用简易程序办理较多,处罚主要集中在公共场所、医疗卫生方面,案件主要来源于日常监督检查,罚款案例逐年递增,表明处罚力度不断加大,部分案由因取证容易被使用较多。结论深圳市南山区2013年11月—2016年10月的卫生行政处罚案件情况基本反映了该区卫生监督执法现状及执法人员的办案能力。应加强案由的运用,增加一般程序使用频次,不断改进和提高行政处罚工作质量。

Objective This study aimed at providing a reference for how to improve the cases quality of health administrative penalty and health inspection, by analyzing those cases from November 2013 to October 2016 in Nanshan, Shenzhen.Methods Comprehensive and detailed analysis was conducted on cases of administrative penalty dealt by Shenzhen Nanshan health supervision center from November 2013 to October 2016.Results Cases dealt by Shenzhen Nanshan health supervision center, which mainly comes from daily supervision and inspection, were always executed in facile civil procedural process and mainly concentrated on public places and medical institutions. The amount of fine was increasing year by year,which indicated that the intensity of punishment was synchronously enhancing. However, certain causes of actions were frequently adopted because of handy evidence collection. Conclusion The present condition of health inspection and the law enforcement officials＇ capability in handling the cases can be basically reflected from those cases from November 2013 to October 2016 in Nanshan,Shenzhen. Next, we have to increase the executing capacity in cases application and the frequency of general procedure, thereby gaining constant quality improvement in administrative punishment.
