对我国冷库安全标准的分析与建议

Analyses and Suggestions on Safety Standard of Cold Storage in China

从性质上分析,安全标准属于强制性标准,具有法律性质的技术规范,相当于"技术法规";从约束力分析,安全标准对政府管理部门及其工作人员在履行监督管理职责时具有法律约束力,对企业及其工作人员在经营生产活动中同样具有法律约束力。法律规定的责任主体不执行安全标准要承担相应的法律责任。在性质和约束力分析的基础上,进一步分析了近几年冷库安全事故多发的主要原因,从冷库安全标准的制定和执行二个方面提出了几点看法和建议。

Analyzing from a nature aspect, safety standards are compulsory standards and technical specifications in legal nature,which are similar to ＂technical regulations＂. Analyzing from binding aspect, safety standards are legally binding for government management departments and their staffs while performing supervision and administrative duties. This is the same for corporations and their staffs in operation and production activities. The main duty body in law who does not implement the safety standards is subject to corresponding legal responsibilities. Based on the analysis of nature and binding, the primary reasons for cold storage accidents that have happened in recent years are analyzed, opinions and suggestions on the enactment and implementation of cold storage safety standards are put forward.
