Discussion on Demand Guarantee Issues of International EPC Project

在国际承包项目中,业主为了避免承包商违约,通常要求承包商提供各种保函作为项目履约的保证。但是近些年来,国外业主索兑或恶意索兑承包商保函的事件时有发生,给国内的EPC承包商造成了很大损失。此文通过对实际经历的保函索兑案例进行探讨和分析,总结应对保函索兑的经验教训,并提出相应的建议和意见。

Among international EPC projects,the owner usually would require contractor to provide various letters of guarantee to ensure the performance of the contract. However,some overseas owners demand or maliciously demand letters of guarantee occasionally in recent years,which has caused great loss to the Chinese EPC contractor. This essay,based on actual case and practice of letter of guarantee dispute,analyzes and summarizes lessons and experience of relevant cases and provide comments and suggestions accordingly.
